Insolvency fees and creditor oversight

Read fee proposals, distinguish remuneration from expenses and find the correct information and challenge rights.

An office holder’s fees are paid under the applicable legal and approval arrangements. Creditors need to understand the basis, work proposed, costs incurred and effect on available funds. A large realisation is not itself a measure of the amount creditors will receive.

Understand what is being approved

Remuneration may be based on time, a fixed amount, a percentage or an authorised combination, depending on the procedure. The approving body and supporting information requirements vary. Read whether the request concerns a basis of charging, an estimate, a cap, an increase or fees already incurred.

Expenses and disbursements are not all treated in the same way as remuneration. Payments to associates and services supplied within a practice need particular transparency. Compare the explanation with the work actually necessary in the case rather than judging the figure in isolation.

Read the reports together

Track asset realisations, outstanding work, costs and the expected distribution through successive reports. A receipts-and-payments account may show cash movements without explaining every liability or future cost. Ask a focused question identifying the task, period or category you want explained.

  • Use the guide for the correct procedure and jurisdiction.
  • Check which version applies to the appointment.
  • Keep the original approval and later progress reports.

Separate concerns from legal challenges

Creditors can have rights to further information and to challenge remuneration, but thresholds, standing and time limits vary. A complaint about professional conduct is not a substitute for a court application and does not automatically stop a deadline. Read the notice and explanatory fee guide as soon as they arrive.

Technical detail

Statement of Insolvency Practice 9 sets professional expectations concerning payments and disclosure. The statute and rules determine the legal route for fixing or challenging remuneration.

The position in Northern Ireland

Use a Northern Ireland creditor fee guide and the local Order and Rules. Professional-body SIP pages identify jurisdiction-specific standards. Do not select an England and Wales explanatory note simply because the office holder’s practice operates across the UK.
